قرار بعودة محمد بن يوسف لإدارة مجلس المصرف الخارجي

وجّهت إدارة القانون مراسلة إلى وزير الإقتصاد والصناعة المكلّف فرج عبد الرحمان بومطاري، تقضي بضرورة عودة محمد بن يوسف لإدارة مجلس المصرف الخارجي، وفق نسخة رسمية من المراسلة تحصلت عليها تبادل.

وأوضحت الإدارة أن مجلس الإدارة الموقوف ليس له الأهلية لممارسة اختصاصات وصلاحيات المجلس مضيفا أن الأهلية تصير إلى لجنة الإدارة المؤقتة إذا روعي في تعيينها الشروط الواجب توافرها وفقا للمادة “68” من قانون المصارف.

وأشارت المراسلة أنه عند نهاية مدة الأيقاف مجلس الإدارة وفق المادة “47 من القانون رقم 19/2013، أو المادة “119” من القانون “1/2005″المذكور دون أن يتمحض عن إجراء الوقف ما يسقط العضوية، فأن أهلية مجلس الإدارة الموقوف تعود إليه بعد زوال العارض، وتصير لجنة الإدارة الإدارة المؤقتة التي كلفت بدلا عنه لا أهلية لها.
